Legal rights on returning furniture to a store

Entitlement to cash back vs. just a credit note

Hi
Bought a baby bed without matress in S. two days ago, it was delivered quickly and was not a special order (abholwaren). Anyway, the bed looks totally different from what it looked in the shop...and I want to give it back.
Segmüller are saying they will only give me a credit note, obviously I would prefer the hard cash. Does anyone what my legal entitlements are?
Any help at all would be great?

Save yourself the hassle and take the credit.

Trust me, you will be on a first name basis with all the Segmüller staff if you choose this battle.

Took us months to get them to replace a damaged table leaf once and that was legit. Lesson learned, open and inspect all deliveries before signing on the dotted line - no matter what the delivery guy says. Do not accept if damaged or wrong.

Been there. Done that.

Unless you ordered online, there is no legal requirement for them to take it back at all. So I would take the credit note.

Close but not quite true.

There is no legal requirement for them to take it back and give you money or a credit note but if the item is damaged or not to spec then you have to give them an opportunity to repair or replace it. If they dont or manage to do it wrong twice, *then* you can demand your money back.

If its a case of "it looked different in the catalog and now I dont like it" then a credit note is a good offer. Thats one of the many reasons to go to Ikea - Three months money back guarantee, no questions asked.

Is it actually a different bed or do you just not like it in your home as opposed to in the shop?

Is its the former, you can demand that they give you the bed you ordered and if they cant or wont, then you can demand your money back.

If its the latter then its purely voluntary customer service ("Kulanz") on their part to offer you even a credit note.

My parents went through this once. It was very stressfull. They get the money back after 1-2 years by
sueing the company formally. In their case it was a bigger value, a complete set-up for a living and dining room.
The items were not exact the color, size and design they ordered.
