How to ensure getting back a flatshare 'kaution'

hi. i left a note to the roommate (she is paying rent for the whole apartment, and subletting me a room, with equal access to kitchen and bathroom) early this morning that i want to move out the end of this month. because of the contract that said i need 4 weeks notice, and also i need to pay for the full month at the beginning of the month, i was afraid if i may have to pay till the end of december.

but when i got back now, she left a note at the door, that i have been such a unimaginably nasty roommate, never satisfied, and she did everything to be a great roommate, and she never had problem with any untermieter before (i explained in other thread, but the day i told her i move in, she had the door locked from inside, saying that the untermieter before me who left 2 month ago still had the key and she was afraid if he comes in...)... she was in her room so i asked her to talk with me about this to be sure i understood her correctly... she went on to complain that it is only one time she did this because of this, or that, because of whatever, and that i should not have a problem if it is only one day that she decided to turn off the gas for the apartment (because she was away and did not need it), or had the only sink totally blocked for 2 days... or to get into my room to look through something in my closed boxes in my room without asking or telling me because she was doing a favor for me...

and she is now blaming me for the damage she caused last night to the downstairs neighbor because the hose from her washing machine was not properly placed in the bathtub like it always should be...

i did not touch any hose anywhere...

so i asked her if i get the kaution back if i left the room as i found it when i moved in. she said ja, but again said i am supposed to pay for the damage...

her cats destroyed my friend's airmattress and she never paid for it.

uh, the thing is, i would like to have the kaution back. do you get it back when you give the keys back (if everything is in order), or is it bank transfered later?

is it a good idea to join mietverein? or is it too late because the problem already started before i join the mietverein? do they even deal with subletting wg situation like mine?

i appreciate any help...

join the Mieterverein now, your problem with the Kaution may then only arise AFTER you've joined.
it's only 55€ a year (IIRC) and it's always useful to have if you are planning on renting while you stay in Munich.
meanwhile keep a diary of all your room-mate's odd behaviour.

you can join the mietverein now and they'll give you advice. How much was your kaution for? I know the Mietverein have a service where one of their team will come out and do the ubergabe with you to see why and where any money is being taken, but they do charge for this, about 100 euros I think...
