How much notice should be given to a roommate?

He pays rent to me, the lease is in my name

I need to move in a hurry, one month from today, but am worried about my roommate situation because I don't know how much notice I have to give him. My name is on everything, he just gives me rent every month. I had the place first and then four months ago decided to rent a room. If he fights me on this, will I have to keep my place longer because of him? Thanks so much for any help or advice you can give!

I should mention he is part of the reason I need to move...

If your name is on everything then I would consider he is up shit creek without a paddle and the period of notice you give him is entirely voluntary.

OK, thanks for the response. I don't want to screw anyone over, but he's been a nightmare and followed nothing in our (verbal) agreement and is big part of the reason I'm giving up the place.

Why not leave NOW, or NEXT WEEK or or or ... Oh I guess it does not fit into your plans.

It's easy to judge when you don't have the whole story. Remember, I said I have to move in 30 days. He is willfully breaking house rules and now I am solely liable because my name is the only one the contract. And I'm working to get 2.5 months before he has to go. I just put the worst case scenario up in case it doesn't fly due to the rules that have been broken. But never mind. Not up for an argument. Cheers.

It sounds really shitty, I know. ph34r.gif In hindsight, I would have had the same response as you did after reading the post...but it's a really complicated situation...he's put me in bad position and I'm still trying to figure out a way to be fair...I've even found a couple places in the same price range with much more lax house rules and no agency fee so he'll have something to work with...anyway...cheers...

Kick his ass to the curb! You are the responsible party. If the dude has been a problem before it shouldn't be that hard to tell him that he is about to homeless.

BS. Verbal agreements are binding, especially (!) in rental matters. A lot of people underestimate that, but if you haven't set defined notice periods, he's fully entitled to the standard notice period in this case. Fully enforcable in court, if he wants, based on the rental agreement.

And that means he has three months if he wants them - if he got an empty room from you. Furnished, he's entitled to 2 weeks.

As a regular with a rental contract in the house, you have 3 months yourself. Minimum. No matter what they might say. What's the problem?
