Short-changed by a cafe waiter

€20 note mistaken for €5, what is my recourse?

Yesterday (Sunday ) I went for a walk along the Isar, and afterwards into an Eis Cafe for coffee.

Upon payment of the bill, I gave the young waiter 20 euro, and he gave me change for 5 euro, then went to the till. I though he was going to fetch some change.

Anyway I immediately called him back, and requested my change, and he said I only gave him 5 euro.

An arguement followed, but at the end of the day I walked out of the place 15 euro worse off.

What should one do in these circumstances, and can I still make a police report.

Ask them to make a count of the register, at the time you have the dispute. They know how much money they started with, and can sum up the receipts and see if there's an extra €15 laying around.

I forgot to mention, when he was at the till, he quickly removed something from the wallet and hid it. But i was not watching carefully, so I did not see where he hid it.

put it down to one of those "life experiences" and move on.

Did you ask for the manager? That's the only way to go.

He was the manager, at least that is what he told us

These places have the owner's name visible at the entrance. I wouldn't have believed him without ID, and I would have kicked up a ruckus for all to hear. I'm sure that you did that, though.

You do have a legal claim, but since it's not easy to prove, the thing's dead as a doornail.

Go for a police report - nothing will come of it apart from hopefully some well-deserved hassle for this guy.

Also, give them some bad reviews on any sites you can find. Fraid this is all you got.

The same thing happened to my boyfriend and I inside a bar here. We kept checking our drink amount and what we would have to pay when leaving the whole night because we didn't have so much cash on us, and we knew the place didnt accept cards. So we knew exactly our amount to pay. The lady came (it was after 01.00 or something) and we paid. We gave her a 20 euro bill and waited for our change, then she was fumbling around with her wallet and told us thank you and stood up. We asked politely if we could have the rest of our change (would have been 6 euros or something). At first she acted like she couldn't hear us, smiled and started to walk off. I got loud and asked her to come back and please give back the change (this time in english). She came back and asked me what change. I explained the situation and my boyfriend (bavarian) also said that we need our change back. She then looked at him and told him to 'calm down' and to stop being aggressive! We were sitting there, completely normal asking for our money! I told her that if she didn't give us the money, I would not leave the bar without calling the police right away. That got her attention and she took out the change and threw it at me!

Always threaten with the police. If you're threats dont work, actually call them. Tell them that the restaurant you are at have taken your money. Do it right away though! Dont leave and come back. Stand there and call them! Dont lose your cool and be polite and everyone will see that you are telling the truth.

I had a simillar story in Starnberg, the cafe just by the lake.
The waiter pretended he did not know what was going on (I took a coke only, gave him 20 eur bill and never got any change). I asked for the manager to come over and he quickly solved the issue without any investigation assuming the customer is always right. I was happy with the way manager acted but will never visit the place again.

Flappy,

At least tell us the name of the place so we can boycott it or go by and give them a hard time.

This makes me think that it's a good idea to carry small bills, maybe stopping at a grocery store or something before stepping out, or if you are already out and realizing that you don't have small bills with you. What a shame, but thank you for sharing your experience.

I think that's more a Munich thing... never happens up here cool.gif

Think this can happen anywhere.

Many many years I ago I was in Ibiza with some friends and we went to some restaurant. On our table we had a really lousy and impolite waiter. We paid for the meal and never got the change, so we called him back over to ask for it. He complained to us by saying: "This isn't McDonald's, you know". A few unpleasent words were exchanged then we promptly got our money back.

Consequently, I only tip if the service is good. That rarely happens here in Germany.

This happened to my brother and I when we went our for my birthday (irrelevant) but anywho. My brother gave the woman 60 instead of 40 (2 notes were new and stuck together)... we asked her again how much we gave her and she said 40. Lying bitch, but my brother and I couldn't be bothered to argue and were 20 down.

I'm not going back to that restaurant again.
