Risks of illegally downloading stuff in Germany

My housemate said that downloading stuff illegally here is very risky (without hiding one's IP). Is that true? (How can it be true? How can that even be controlled?)

Many sites and programs that are used to download illegally are well known to the police. They have programs to trace people who download, they can hand in the IPs to your provider which will then give them your information.

It is risky. If you have tons of "stuff" open and shared out on the P2P networks then be warned that the P2P networks/shares
are monitored by copyright holders or their reps (RIAA/MPAA/EFI/Bertelsmann/etc.) and your might get sued.

Now that thats said and done there are some other things to add.

1. Most ISPs will not give out your Private account info. without a court order. Some do (and yes it's againt the EU Priv. Laws and you could sue them) so be warned.
2. German courts and lawyers are getting tired of these P2P/file sharing cases and are starting to throw them out before they even goto trial. This doesn't mean
that your case will automagically get tossed, but it is happening.

Though they are undoubtedly as illegal in Germany as in the US, how is copyright enforcement in Germany? I am hoping to be able to keep up with some of my US shows, movies, music, etc via bittorrent, but didn't know if there was any consensus on likelihood of getting caught etc. In the US, it seems to be if you don't run oink, and you're not one of 10 very unlucky college kids a year, you're pretty well alone as long as you don't hop on public trackers and such... Thoughts?

German Federal prosecutors in most states have already said they will not prosecute P2P users
unless your sharing large amounts of content. (Over 1900 Songs).. So don't worry to much..

On the other side, try getting your content through a better method. If you don't know where
that is, then do some Google digging, or read one of the many previous threads here..
